Welcome to KIVO.These Terms & Conditions (“Terms”) govern your use ofthe KIVO website, training services and any associated products or servicesprovided by KIVO (“KIVO”, “we”, “us” or “our”).By creating an account, purchasing a subscription or usingour services, you agree to these Terms.
1. About KIVO
KIVO provides personalised endurance training plans andcoaching support designed to help athletes train around their goals, fitness,availability and lifestyle.KIVO may provide training recommendations for activitiesincluding running, cycling, swimming, triathlon, strength and conditioning,recovery and related endurance training.

2. Who can use KIVO
You must be at least 18 years old to create a KIVO accountor purchase a KIVO subscription unless we have expressly agreed otherwise.You are responsible for ensuring that the information youprovide to KIVO is accurate and up to date.This includes information about your training history,current fitness, availability, goals, injuries, health considerations and otherinformation that may affect your training.
3. The KIVO service
Depending on your chosen plan, KIVO may provide services
including: personalised training plans; scheduled workouts; regular training reviews; adaptations to your training plan; communication and coaching support; analysis of training information; and integration with or use alongside third-party training platforms and fitness services.The exact features available to you depend on the KIVO planyou select.We may improve, modify or update features of the KIVOservice from time to time.
4. Free trial
KIVO may offer new athletes an initial free trial or freetraining period.Unless stated otherwise, no payment will be taken during agenuinely free trial.At the end of the free period, you will be given theopportunity to select a paid KIVO plan if you wish to continue.Where a free trial will automatically convert into a paidsubscription, this will be made clear before you begin the trial, including theprice that will apply and when the first payment will be taken.You are under no obligation to purchase a paid subscriptionsimply because you have completed a free trial unless you have expressly agreedto an automatically converting subscription.
5. Paid subscriptions
KIVO currently offers paid subscription plans, which mayinclude KIVO Pro and KIVO Elite.Current prices and the features included with each plan willbe displayed on the KIVO website before purchase.Paid plans are billed monthly unless clearly statedotherwise.When you purchase a monthly subscription, you authorise KIVOand its payment provider to charge the applicable subscription fee using yourselected payment method.Your subscription will continue monthly until cancelled.We may change our subscription prices. If the price of yourexisting subscription is changing, we will provide reasonable notice before thenew price applies to you.
6. Payments
Payments may be processed through a third-party payment provider such as Stripe. KIVO does not need to directly store your full payment carddetails where these are handled securely by our payment provider.You are responsible for maintaining a valid payment method.If a payment fails, we may contact you and/or temporarilysuspend access to paid services until payment is successfully completed.
7. Cancellation
You can cancel your KIVO subscription at any time.Unless otherwise stated at the point of purchase,cancellation will prevent your subscription from renewing at the next billingdate.You will normally retain access to your paid KIVO serviceuntil the end of the period you have already paid for.Cancellation does not automatically entitle you to a refundfor a subscription period that has already begun, except where you have a legalright to one.Nothing in these Terms affects any cancellation or refundrights you have under applicable UK consumer law.Further information is available in our Cancellation& Refund Policy.
8. Training and health disclaimerKIVO provides fitness, training and coaching guidance. Itdoes not provide medical advice, diagnosis or medical treatment.Physical exercise carries inherent risks, including fatigue,illness, accident and injury.You are responsible for deciding whether you are physicallycapable of completing any training session or activity suggested by KIVO.You should not begin or continue exercise where you havebeen advised not to do so by an appropriate healthcare professional.If you experience pain, dizziness, chest pain, unusualshortness of breath, illness or other concerning symptoms, you should stopexercising and seek appropriate medical advice where necessary.You should tell KIVO about relevant injuries, illnesses orcircumstances that may affect your ability to train so that these can be takeninto account where appropriate.However, KIVO is not a substitute for advice from a doctor,physiotherapist or other qualified healthcare professional.
9. Training recommendationsTraining plans are recommendations rather than guarantees.Your ability to complete a session safely can be affected byfactors that KIVO cannot fully assess, including weather, terrain, traffic,equipment, illness, fatigue, nutrition, hydration and changes in your physicalcondition.You should use reasonable judgement when completing trainingand adapt or stop a session where circumstances make it unsafe or inappropriateto continue.
10. Results and performanceKIVO aims to help athletes train effectively towards theirgoals, but individual results vary.We cannot guarantee that you will achieve a particular racetime, fitness improvement, weight change, performance level or other outcome.Performance can be affected by many factors outside KIVO'scontrol, including consistency, health, sleep, recovery, nutrition, lifestyle,genetics, environmental conditions and competition circumstances.
11. Athlete responsibilitiesTo get the most from KIVO, you should provide accurateinformation and communicate meaningful changes that may affect your training.You remain responsible for: completing training safely; using suitable equipment; following applicable road, trail, pool and facility rules; choosing appropriate locations for training; adjusting training when conditions are unsafe; seeking professional medical advice where appropriate; and ensuring that any devices or equipment used during training are safe and suitable.
12. Third-party platforms
KIVO may work alongside or link to third-party services suchas training platforms, fitness trackers, wearable devices or activity services.These services are operated independently and may have theirown terms and privacy policies.KIVO is not responsible for outages, errors, lost data,changes to functionality or other issues caused by third-party services thatare outside our reasonable control.Where an integration becomes unavailable, we may provide analternative way of delivering the relevant part of the KIVO service wherereasonably possible.13. Intellectual propertyThe KIVO name, branding, website content, trainingmethodology, written materials and other original KIVO content are owned by orlicensed to KIVO.Your training plan is provided for your personal use.You must not reproduce, sell, commercially distribute orrepublish KIVO training plans or other KIVO content without our permission.Nothing prevents you from discussing or sharing your owntraining experience, results or individual workouts for normal personal andsocial purposes.
14. Acceptable use
You must not misuse the KIVO website or services.This includes attempting to gain unauthorised access to oursystems, interfering with the operation of the service, using the service forunlawful purposes or reproducing KIVO content commercially without permission.We reserve the right to suspend or terminate an accountwhere there has been serious or repeated misuse of the service.
15. Personal information
We collect and process personal information in order toprovide the KIVO service.This may include information about your fitness, traininghistory, injuries and other health-related information that you choose toprovide.How we collect, use, store and protect personal informationis explained in our Privacy Policy.Where UK data protection law requires additional consent oranother lawful basis for processing particular categories of information, wewill handle that separately and appropriately.
16. Availability of the service
We aim to provide a reliable service but cannot guaranteeuninterrupted availability.There may occasionally be interruptions caused bymaintenance, technical problems, third-party platforms or circumstances outsideour reasonable control.Where possible, we will aim to minimise disruption andrestore affected services promptly.
17. Limitation of liabilityNothing in these Terms excludes or limits liability wheredoing so would be unlawful, including liability for death or personal injurycaused by negligence, fraud or fraudulent misrepresentation, or your statutoryconsumer rights.Subject to those rights, KIVO is not responsible for lossesthat were not reasonably foreseeable when you entered into your agreement withus.KIVO is intended for personal and recreational use. We arenot responsible for business losses, loss of profit or other commercial lossesarising from use of the service by a consumer.Nothing in these Terms removes your rights under applicableUK consumer law.
18. Ending your KIVO account
You may stop using KIVO and cancel your subscription inaccordance with the cancellation terms above.We may suspend or terminate access where: payment remains outstanding; you seriously or repeatedly breach these Terms; you misuse the service; or continuing to provide the service would be unlawful.Where reasonable, we will contact you before terminatingyour account and give you an opportunity to resolve the issue.
19. Changes to these TermsWe may update these Terms from time to time to reflectchanges to KIVO, applicable law or the way our services operate.The latest version will always be available on our website.If we make a significant change that materially affects anexisting paid subscription, we will provide reasonable notice.
20. Governing law
These Terms are governed by the laws of England and Wales.If you are a consumer living elsewhere in the UnitedKingdom, you may also have rights under the laws applicable where you live.Nothing in these Terms limits any mandatory consumer rightsavailable to you.
